Malaysian labour law map: statute, regulator, portal, scope

Every Malaysian employment statute mapped to the department that administers it, the portal you actually file in, and what it governs.

30-second answer Reviewed 22 Jul 2026

Malaysian employment obligations are split across sixteen statutes and roughly ten authorities. Labour standards sit with JTKSM in the peninsula and with JTK Sabah and JTK Sarawak in East Malaysia; disputes with JPPM and the Industrial Court; safety with DOSH; and the contribution schemes with KWSP, PERKESO and HRD Corp. Each has its own filing portal, and none of them talk to each other.

  • Three separate labour-standards statutes: Act 265 for the peninsula, Sabah Cap. 67 and Sarawak Cap. 76 for East Malaysia.
  • JPPM sits at jpp.mohr.gov.my — not jppm.mohr.gov.my, which does not resolve.
  • Act 446's official short title is the Employees' Minimum Standards of Housing, Accommodations and Amenities Act 1990.
  • KESUMA has no domain of its own; mohr.gov.my remains the canonical ministry site.
  • The Anti-Sexual Harassment Tribunal is TAGS, at tags.kpwkm.gov.my, and sits under KPWKM rather than the Ministry of Human Resources.
  • The Gig Economy Commission (SEGiM) has no verified standalone portal; gig complaints route through eAduan Gig.

Who this applies to: HR, payroll and compliance teams that need to know which door to knock on.

Nobody publishes this, which is odd, because the first question in any Malaysian compliance problem is not what does the law say — it is whose law is it and where do I file. Answering that wrongly costs weeks: a s.20 representation lodged with the wrong department does not stop the 60-day clock, and an approval sought from JTKSM for a Sabah employee is not an approval at all.

Every URL below was checked. Where a commonly cited address does not resolve, that is noted, because those are the ones that waste an afternoon.

Labour standards

StatuteActAuthorityPortalGoverns
Employment Act 1955265Department of Labour Peninsular Malaysia (JTKSM) — jtksm.gov.myComplaints via SisPAA, mohr.spab.gov.myHours, leave, wages, harassment, FWA, forced labour — peninsula only
Labour Ordinance (Sabah)Sabah Cap. 67Labour Department Sabah (JTK Sabah) — jtksabah.gov.myeNORES, enores.jtksabah.gov.myThe same ground, in Sabah
Labour Ordinance (Sarawak)Sarawak Cap. 76Labour Department Sarawak (JTK Sarawak) — jtkswk.gov.myALIANCE, aliance.sarawak.gov.myThe same ground, in Sarawak
Children and Young Persons (Employment) Act 1966350JTKSM / JTK Sabah / JTK SarawakNo dedicated portalEmployment of minors
Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990446JTKSM and the state departmentsSistem Permohonan Perakuan Penginapan, akta446.mohr.gov.myEmployer-provided accommodation and the Certificate for Accommodation
National Wages Consultative Council Act 2011732Council secretariat at MOHR; enforced by the labour departmentsgajiminimum.mohr.gov.myThe minimum wage, set by gazetted Order

The commonly cited minimumwages.mohr.gov.my does not resolve. The live minimum-wage site is gajiminimum.mohr.gov.my.

Disputes and unions

StatuteActAuthorityPortalGoverns
Industrial Relations Act 1967177Department of Industrial Relations (JPPM) — jpp.mohr.gov.myIRIS, iris.mohr.gov.myUnfair dismissal representations, conciliation, trade disputes
Industrial Court of Malaysia — mp.gov.mye-Filing mp.gov.my/ef, e-Mention eic.gov.my/eicxAdjudication of references and awards
Trade Unions Act 1959262Department of Trade Union Affairs (JHEKS) — jheks.mohr.gov.mye-TUIS, e-tuis.jheks.gov.myUnion registration and administration

jppm.mohr.gov.my does not resolve. JPPM’s actual domain drops the second M. It is the single most repeated broken reference in Malaysian HR writing.

Safety and health

StatuteActAuthorityPortalGoverns
Occupational Safety and Health Act 1994514Department of Occupational Safety and Health (DOSH / JKKP) — dosh.gov.myMyKKP, mykkp.dosh.gov.my; APIS, apis.dosh.gov.myEmployer safety duties, OSH coordinators, accident notification

Note www.dosh.gov.my does not resolve — use the apex domain.

Contributions

StatuteActAuthorityPortalGoverns
Employees Provident Fund Act 1991452EPF / KWSP — kwsp.gov.myi-Akaun (Employer), secure.kwsp.gov.myRetirement contributions
Employees’ Social Security Act 19694PERKESO — perkeso.gov.myASSIST Portal, assist.perkeso.gov.myEmployment injury and invalidity
Employment Insurance System Act 2017800PERKESOASSIST; claims via LINDUNG KERJAYARetrenchment income replacement
Self-Employment Social Security Act 2017789PERKESOASSIST / SKSPS registrationSelf-employed and gig worker cover
Pembangunan Sumber Manusia Berhad Act 2001612HRD Corp — hrdcorp.gov.myeTRiS, etris.hrdcorp.gov.myTraining levy and claims

kwsp.gov.my returns 403 to automated clients. That is bot protection, not an outage.

The two newest, and the awkward ones

StatuteActAuthorityPortalGoverns
Gig Workers Act 2025872SEGiM; conciliation via JPPM; social security via PERKESO; enforcement support from JTKSM and DOSHeAduan Gig, eaduan-gig.mohr.gov.my; Act microsite mohr.gov.my/aktapekerjagig2025Service agreements, gig worker rights, the Gig Workers Tribunal, platform SOCSO deduction
Anti-Sexual Harassment Act 2022840Ministry of Women, Family and Community Development (KPWKM) — kpwkm.gov.myTAGS portal, tags.kpwkm.gov.my/portalComplaints of sexual harassment by any person, employment or not

Two things to hold loosely here. The Gig Economy Commission (SEGiM) is not established by Act 872 — the Act creates a Tribunal and a Consultative Council — and no standalone SEGiM domain could be found. Treat statements about its powers as unconfirmed until the instrument creating it surfaces.

And the harassment tribunal is TAGSTribunal bagi Antigangguan Seksual. The abbreviation TTGS, which appears in some write-ups, points at a domain that does not exist. It also sits under a different ministry from everything else on this page, which is why a harassment matter can be running at KPWKM and at JTKSM simultaneously without either knowing.

Where statutes actually live

Two repositories, both official: the Attorney General’s Chambers Federal Legislation Portal at lom.agc.gov.my, and the ministry’s own eakta.mohr.gov.my. LOM serves the older Acts cleanly at a predictable path; several of the newer ones — 612, 732, 789, 800, 840, 872 — currently error there and have to be sourced from the administering agency instead.

One naming note that trips people up: the Ministry of Human Resources rebranded to KESUMA, but the rebrand was naming only. kesuma.gov.my does not resolve. mohr.gov.my remains canonical, and every subdomain in the tables above hangs off it.

Common mistakes

Filing a s.20 representation with JTKSM. Unfair dismissal goes to JPPM, through IRIS. JTKSM handles labour standards. The 60-day window does not pause while a misfiled representation sits in the wrong inbox.

Using Act 265 for a Sabah or Sarawak employee. Different statute, different department, different portal.

Citing Act 446 by the wrong name. It is the Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990.

Assuming one ministry. Harassment tribunal matters sit with KPWKM; everything else on this page sits with MOHR.

Assuming SEGiM has statutory powers under Act 872. It does not appear in the Act.

What’s next

Pin the portal column to your compliance calendar, not the statute column — the statute tells you what is owed, the portal is where the deadline is actually met. Then read the Employment Act guide for the peninsula, and the Sabah and Sarawak page if any of your headcount sits across the sea.

⚑ Awaiting expert verification

The following are deliberately unstated or described only qualitatively until confirmed by a subject-matter expert:

  • Confirm the legal instrument establishing the Malaysian Gig Economy Commission (SEGiM) and its powers — it is not established by the Gig Workers Act 2025
  • Confirm whether the Gig Workers Tribunal has a standalone registry address or portal separate from eAduan Gig
  • Confirm Act numbers 612, 732, 789, 800, 840 and 872 against lom.agc.gov.my once those PDFs are served — they are currently confirmed from agency sites rather than the LOM repository
