The number on that agent’s chest badge is not decoration — it is the only quick way to tell a legitimate negotiator apart from someone who merely claims to be an agent. In Malaysia, who may sell, rent out or negotiate property on your behalf is tightly regulated by law.

Who is qualified to act as a property agent?

The practice of estate agency is regulated by the Board of Valuers, Appraisers, Estate Agents and Property Managers (LPEPH, also known as BOVAEP) under the Valuers, Appraisers, Estate Agents and Property Managers Act 1981. According to the Board, “only those registered under the Board may act as an Estate Agent”.

A property negotiator — commonly referred to as a REN (Real Estate Negotiator) — is an assistant employed by an agency firm. They are not independent agents: according to the Board, a negotiator may only work for one estate agent at any given time and on a full-time basis only, and is “not permitted to act independently of the estate agency firm”.

How do I verify a REN or agency firm?

Do not rely on a name card or logo alone. Verify registration status directly with the Board:

  • Online check — use the official LPEPH portal at lpeph.gov.my/search-listing to check firms, agents and negotiators.
  • Contact the Board — if in doubt, call LPEPH at +603-2288 8815/16/17 or email info@lpeph.gov.my to confirm that a person is genuinely attached to the firm they claim.
  • Ask the firm — since a negotiator is only legitimate under one firm, confirm with the agency firm concerned that the individual truly represents them.

How much fee and commission is allowed?

The scale of fees is set out in the Seventh Schedule (Rule 48) of the Valuers, Appraisers and Estate Agents Rules 1986 under the 1981 Act. For the sale of land and buildings, the official LPEPH website states that the following rates are the maximum rate, not a fixed rate.

An agent may also claim additional costs such as advertising, printing and travel (only when the distance between the agent’s office and the property exceeds 40 km) — but, according to the LPEPH fees page, these additional claims “may not be imposed by a registered estate agent without the client’s prior consent”, not automatically.

What are the warning signs of a questionable agent?

  • Refusing to show a REN tag or registration number, or their name not appearing in the LPEPH check.
  • Claiming to be an “independent agent” without being attached to any registered firm — a structure the Board does not permit.
  • Demanding a commission exceeding 3% for a sale, or additional charges you never agreed to in advance.
  • Asking for a deposit or “processing fee” to be paid directly into an individual’s personal account rather than the firm’s account.
