Trademark Classes and MyIPO Fees

The 45 Nice classes as MyIPO applies them, with the current MyIPO fee schedule under the Trademarks Regulations 2019 — filing, opposition, renewal, recordal and Madrid handling fees.

Malaysia uses the Nice Classification — 34 goods classes and 11 service classes. MyIPO charges per class, not per application: RM950 per class if your goods and services wording is taken from MyIPO's pre-approved list, RM1,100 per class if it is not. Renewal is RM1,000 per class every ten years. A single application may cover several classes under s.18 of the Trademarks Act 2019, but the fee still multiplies.

Common mistakes

Budgeting for one fee. Three classes at RM1,100 is RM3,300 before anyone has looked at your mark. Decide the class list first.

Drafting your own specification without checking. Using MyIPO’s pre-approved list saves RM150 per class and removes the most common formality objection. MyIPO puts the burden of the pre-approved claim on the applicant, so an unsupported TMA2A claim invites a provisional refusal.

Forgetting that opposition costs both sides. Filing an opposition is RM950 per class; defending one is RM350 per class for the counterstatement, plus RM200 per month for every extension.

Assuming an assignment is free to record. RM300 per application, and until it is recorded, s.65(2) of the Trademarks Act 2019 makes the transaction ineffective against someone who acquires a conflicting interest without notice of it.

How many classes do I need?

As many as describe what you actually sell, plus what you are about to sell. A cafe selling packaged coffee typically needs class 30 for the coffee and class 43 for the cafe service. Each class is a separate RM950 or RM1,100, so the class count is the single biggest driver of cost.

What is the difference between the RM950 and RM1,100 fee?

RM950 (fee code TMA2A) applies where every item in your specification is taken from MyIPO's pre-approved list of goods and services. RM1,100 (TMA2B) applies where you draft your own wording. MyIPO states the responsibility for claiming the pre-approved list lies with the applicant.

Is a multi-class application cheaper than separate applications?

No. Section 18 of the Trademarks Act 2019 allows one application covering several classes, which saves administration and gives you one file number, but the fee is charged for each class either way.

Can I claim a whole class heading?

MyIPO expressly discourages it. Class headings are general indications only and may not cover the specific goods or services you care about. Itemise the specification instead.
