JAKIM's name is most often seen on the halal logo on food packaging. But halal
certification is only one of this department's several functions. Behind it
sits a broader role: coordinating Islamic affairs at the federal level in a
country that places the administration of Islamic religion in the hands of
the States.

## Constitutional basis

JAKIM's official portal traces its establishment to Article 3(1) of the
Federal Constitution, which places Islam as the religion of the Federation.
The same page also cites Articles 3, 12(2), 37(1), 38(3), 39 and 121(1A) as
the reference framework supporting its mandate.

One point must be stated clearly, because it shapes the form of JAKIM's role:
**the administration of Islamic law is a State matter.** It is listed in the
State List (List II of the Ninth Schedule to the Federal Constitution). Each
State has its own Islamic religious authority, and the Malay Rulers are Head
of Islam in their own States.

That is why JAKIM stands as a federal body that **coordinates and
standardises**, not as an authority that overrides state religious power.

## Founding timeline

According to the "JAKIM Berpelembagaan" page on the official portal:

## Three core functions

JAKIM's official portal lists three core functions:

1. **Formulation and standardisation of syarak (Islamic) law** — efforts
   towards uniformity in law and related matters of Islamic legal rulings
   at the national level.
2. **Coordination and development of Islamic education** — coordination of
   policy and development of Islamic education across the country.
3. **Coordination of Islamic administration** — coordination of the
   administration of Islamic affairs between federal and state agencies.

Under these three functions, the official portal also lists supporting
responsibilities such as acting as the central planning body, safeguarding
the purity of aqidah (Islamic creed), coordinating enforcement mechanisms,
evaluating Islamic programmes, acting as an information centre, and
facilitating regional and international cooperation.

The official page also states JAKIM's vision as "creating effective Islamic
management at the Federal and State levels" and its mission as "becoming an
authoritative source of reference in the fields of aqidah, syariah and
muamalah".

## MKI secretariat

One of JAKIM's ongoing roles is to act as **secretariat** to the National
Council for Islamic Religious Affairs Malaysia (MKI). MKI is the
national-level platform for the coordination and deliberation of Islamic
affairs.

In this capacity, JAKIM manages the committee meetings and expert panels
that discuss matters of syariah, aqidah, tasawuf and falak as the platform
for arriving at decisions at the national level. This secretariat function
means JAKIM provides administrative and research support to the council,
rather than replacing the authorities that make up its membership.

## Halal certification

The JAKIM function most visible to the general public is halal
certification. It is carried out through the **Halal Management Division**.

The official profile of this division states that, as the authority
responsible for Islamic affairs in this country, JAKIM through the Halal
Management Division is the lead agency handling halal certification and
enforcement. It is carried out together with the state Islamic religious
departments, and the official portal states that management of halal
certification was consolidated under JAKIM from 1 August 2009.

Applications and status checks for halal certification are handled through
the official halal portal (the MYeHALAL system) at `halal.gov.my`.

## Coordinating role versus state power

Because the administration of Islamic religion sits with the States, most
of JAKIM's functions are coordinating and standardising in nature — bringing
guidelines together, providing reference material, and coordinating
programmes across the federal and state levels. Implementation on the
ground, enforcement of state syariah law, and the administration of the
Syariah courts remain under their respective state authorities.

This means two layers exist at the same time:

- **Federal level** — JAKIM as coordinator, MKI secretariat, and federal
  halal authority.
- **State level** — the State Islamic Religious Councils (MAIN) and the
  state Islamic religious departments (JAIN) that administer Islamic law
  within their respective territories.

## Common misconceptions

- **Assuming JAKIM is a court or a punitive authority.** JAKIM is a federal
  administrative department. It is not a Syariah court, which is a state
  court established by state enactment.
- **Assuming JAKIM controls the administration of religion in every State.**
  The administration of Islamic law is a State matter; JAKIM's role is
  coordination and standardisation, not a substitute for state power.
- **Equating JAKIM with MKI.** JAKIM is the department that acts as MKI's
  secretariat; MKI is the national-level council itself.
- **Assuming a state halal logo and JAKIM's halal logo are the same thing.**
  Certification is carried out jointly, but JAKIM presents itself as the
  lead agency for halal certification at the federal level.
