e-BOS is the Electronic Beneficial Ownership System — the channel through which
Malaysian companies lodge beneficial ownership information with the Registrar
of Companies.

## What it is for

Division 8A of the Companies Act 2016 requires companies to lodge beneficial
ownership information with the Registrar. Practice Directive 9/2024 provides
that, unless otherwise allowed by the Registrar, that lodgement **must** be made
through e-BOS. The system feeds the Registrar's registry of beneficial owners
(RBO), which sits alongside — and is distinct from — the register each company
keeps at its own registered office.

## Services offered

- **Notification of beneficial ownership information** — adding a new
  beneficial owner or senior management, updating existing particulars, or
  recording a cessation
- **Rectification of beneficial ownership information** — correcting
  information that was wrong when lodged, under s.602 of the Companies Act 2016
  and Practice Note 6/2019, with supporting documents
- **Removal or cancellation** of an entry that should not have been made

Where the register of beneficial owners is kept somewhere other than the
registered office, that location is notified to SSM under s.47(2) rather than
through e-BOS.

## Getting access

Access runs through a verified account rather than an open login. The user
registers on the SSM4U portal and is verified, then applies from the e-BOS
dashboard to upgrade to a **Verified Professional User**. Submissions become
possible once that application is approved, which is not instantaneous.

Most submissions are auto-registered. The exceptions requiring supporting
documents are submissions by companies whose status is other than Existing, and
rectifications under s.602.

## Who can see what it holds

Beneficial ownership information is **not publicly available**. Access to the
Registrar's registry is limited to competent authorities, law enforcement
agencies, public bodies carrying out government procurement, the beneficial
owner themselves and persons they authorise.

The Companies (Access to Register and Information Relating to Beneficial
Ownership) Regulations 2025 took effect on 10 January 2025, made under the
Minister's power in s.60B(9) to prescribe who may access the information, on
what terms, and at what fee. SSM opened a supply facility on 28 January 2025 at
Menara SSM@Sentral, applied for over the counter at a stated charge of RM20.00
per company, with written consent from the beneficial owners required except in
the case of competent authorities and enforcement agencies.
